The DWD session will cover the pitfalls of classifying a worker as an independent contractor from the perspective of the Wisconsin Department of Workforce Development's various agencies. Participants will be given an overview of the various – and different – tests used under various laws enforced by the DWD or programs under its purview. Unemployment Insurance Law considers this issue differently than Workers Compensation Law, which differs from tests used under Wisconsin wage/hour law and anti-discrimination laws. It is important to conduct a careful analysis of each proposed "contractor" position.

Chris Davis currently serves as the Associate Regional Director for the Chicago Regional Office of the Employee Security Benefit Administration, U.S. Department of Labor (DOL). As Associate Regional Director, Mr. Davis assists the Regional Director in carrying out the enforcement program under the Employee Retirement Income Security Act of 1974 (ERISA). In addition, Mr. Davis serves as the Chicago Regional Office’s training coordinator and provides technical review and analysis support to the staff.
His tenure with the DOL began in 1988 as an Investigator. As a Senior Investigator, from 1992 to 2012, he was primarily responsible for conducting and coordinating investigations of employee benefit plans. Mr. Davis holds an undergraduate degree in Business Education from the University of Illinois and a MBA in Finance from Northern Illinois University.
