Session 1

Human resources professionals often engage in important, and often legally sensitive, investigations regarding employees.  This session is designed to help human resources professionals navigate the investigation process in an effective and legally sound manner.  Additionally, this presentation will discuss how to properly discipline or document the need for performance improvement that so often arises from these investigations.  An emphasis will be placed on when to use progressive discipline versus when to potentially use a performance improvement plan.


Participants will:
  • How to conduct an effective investigation consistent with the law;
  • The proper way to document discipline and performance improvement plans (often following an investigation); and
  • The pros and cons of using progressive discipline and performance improvement plans.

 

 

Session 2

This employment law update will address a wide-ranging review of the latest legislative activity and developments and the most complex issues keeping Wisconsin employers up at night. This program will update your organization on pressing employment issues and help you prepare for the challenges ahead. Discussion points will include: 

  • Pregnant Workers Fairness Act - New Regulations
  • Religious accomodation based on recent US Supreme Court guidance

Brian P. Goodman is an attorney and a member of the labor and employment and school law practice groups of Boardman Clark. He assists employers with a wide range of legal issues including, hiring, discipline, terminations, leave issues under the Family and Medical Leave Act (FMLA), accommodation issues under the Americans with Disabilities Act (ADA), and many other day-to-day matters.   Mr. Goodman is a frequent writer, presenter, and trainer on employment law matters. He graduated from the University of Wisconsin Law School, magna cum laude, and was elected to the Order of the Coif. Mr. Goodman currently serves as Past President of the Wisconsin School Attorneys Association, and is a past VP on the GMA SHRM Board of Directors.


Storm B. Larson is an associate with Boardman Clark, Madison where his practice is primarily devoted to labor and employment law. Storm regularly counsels and litigates on behalf of his clients on all aspects of employment law. In his employment counseling practice, he takes a practical approach to help guide employers through difficult scenarios to help them avoid costly litigation and to resolve problems before they escalate. However, when problems do escalate and litigation cannot be avoided, he is experienced in litigating before state and federal courts and agencies. Storm also routinely speaks and presents on employment law issues to help educate human resources audiences on employment law topics.

 
 

Michael R. Gotzler represents employers in all aspects of labor and employment matters, including labor management relations. Mike’s practice includes employment litigation, employee leave and accommodation issues, wage and hour compliance, noncompete agreements and other restrictive covenants, independent contractor issues, and labor relations.
Mike has also represented the staffing industry on a wide range of legal issues and legislative and regulatory matters. He played a key role in passage of the Wisconsin laws that regulate PEOs (professional employer organizations) and was recognized by the industry for his efforts.

Mike has particular skill in responding to claims and issues surrounding joint and coemployment, the use of third party workers, independent contractors, and outsourced HR services. He has presented at national conferences, represented businesses at White House briefings, participated on expert panels and has been regularly interviewed and quoted as a result.

Mike also serves as the Wisconsin coordinator and liaison for Littler’s Workplace Policy Institute (WPI). Mike focuses on Wisconsin state legislative and regulatory developments in employment and labor law, as well as municipal ordinances and regulation of the workplace. He assists the employer community in understanding and impacting Wisconsin legislation before it becomes law.

Jennifer L. Ciralsky advises and represents employers in a broad range of employment law matters arising under federal and state law, including claims based on Title VII, The Family and Medical Leave Act, The Americans with Disabilities Act, The Fair Labor Standards Act, The Age Discrimination in Employment Act and The Wisconsin Fair Employment Act.

She appears before the Equal Employment Opportunity Commission, the Wisconsin Equal Rights Division and in federal courts defending management in employment litigation and administrative charges, particularly in the area of discrimination. Jennifer also represents employers before FINRA.

Additionally, Jennifer counsels clients in wage and hour and FMLA compliance, discipline and terminations, and affirmative action obligations.
