Merry and Bright Greetings to you, my fellow GMA SHRM Members!

Wow, what a year!  2024 has been incredible and there is so much to be thankful for as we are wrapping up the year – too many to mention them all.

I want to recognize all of you who made our events, programming, community engagements, college relations, and partnerships such a success! The energy at our events, including the November legal PDS, was fantastic! While I regret not being able to chat with everyone, it warmed my heart to see so many of your smiling faces. Thank you for joining us and a big thank you to our presenters for their valuable insights!

Legal Update – Employers May Not Rely on Payroll Processor to Circumvent Records Retention Requirements

Under the Fair Labor Standards Act, employers are required to maintain accurate records about an employee’s hours worked and wages earned. This duty is not absolved when the employer uses a third-party payroll company to process its employee paychecks.

In a recent case outside of Wisconsin, several employees from a steel manufacturer sued their employer, alleging violations of the Fair Labor Standards Act and state law. In Hornady v. Outokumpu Stainless USA, LLC, 118 F.4th 1367 (11th Cir. 2024), the employees allege that the company failed to pay wages for all hours worked, improperly calculated overtime, and delayed overtime payments. The company was ordered to turn over time and pay records to the employees. The company failed to do so despite several court orders, and it began to blame its third-party payroll processor for not being “helpful” in producing records to the company. When the company finally produced documents, it provided falsified records and attempted to shift blame to the payroll processor. The court ruled that due to the company’s egregious conduct and failure to comply with providing documents, the company was liable to the employees and was ordered to pay several millions of dollars.

Employers cannot simply rely on other third parties to maintain records required under the FLSA (or other laws). The duty to retain records resides with the employer, even if third parties assist in creating and storing certain records. While the conduct in this case is extreme, it is somewhat common for employers to assume that third parties are storing their records, without verifying the accuracy of that assumption.

This is a great opportunity to stay informed and up to date on all things related to employee relations, workforce policies, employment law, litigations, and more. GMA SHRM Begins SHRM Certification Study Group!

The GMA SHRM Certification Committee is organizing virtual study groups for those actively preparing to take the SHRM-CP or SHRM-SCP certification exams this winter. These sessions will be one-hour, virtual roundtable discussions designed as a supplement to the SHRM class offered through UW Small Business Development Center (UWSBDC) OR for those studying individually using the SHRM Learning System or other self-study material.

The upcoming sessions are December 6th and December 13th. Registration is now available here

New Member Referral Contest
 

The GMA SHRM Membership Committee ran a new member referall contest from September to November and winner were announced at the November PDS.

20 new members saved $25 off thier first year dues and submited who referred them into a drawing for Amazon gift cards.   Gail Johnson for Restaino Relocation was our top referrer followed by Brian Borkovec from Destination Madison.  Two random names were drawn from the list of referrers and Janel Kalish from Third Coast Advisors and Brittany Hanson from Park Bank were also winners!

GMA SHRM – Retiree Membership
 

Have you retired from a career in the HR profession or do you know someone who has?  Want to stay connected to friends and the profession while also giving back?  GMA SHRM now offers a Retiree Membership option.  Dues are discounted to $25 for a 12 month membership for all retired HR professionals. 

To qualify you need to have been employed in Human Resources and no longer represent a company.   We ask Retiree Members get involved and join a committee and/or participate in monthly HR Advice Network group meetings (roundtables).

HR InTouch Guidelines

Article Writing:
Do you have an interest in writing for the HR InTouch? We have an interest in learning more about your area of expertise!
Why should you volunteer? Top three reasons: 1) to share your knowledge and experiences to educate others; 2) to become more connected in the HR and Dane County communities; and 3) to contribute towards the advancement of GMA SHRM and the HR profession.
The first step is for you to choose a submission option: you can pre-submit an article to GMA SHRM at any time for us to use in any of the upcoming newsletters, you can sign up to write for a particular month, or we can put you on a list of people to contact in future months whenever we need articles.
Article length:
Because the HR InTouch is now in an online format, the size is flexible. The article should be engaging and hold readers’ attention. Include the core information in your article, and we will advise if it is too lengthy.
Solicitation:
GMA SHRM is conscious not to allow solicitation through the articles, in an effort to protect the interests of our partners and members. The nature of the article should be educational (i.e., what are the business advantages of having a product like yours) or informational. Otherwise, if you truly are interested in advertising through the HR InTouch, you can work with our Marketing Committee. As a rule of thumb for article writing, if the submission relates to a for-profit event, or specifically markets your company (vs. your industry), it is an advertisement, and should be purchased. If it is a not-for-profit event that your company is hosting, or an announcement (i.e., a SHRM member recently joined your company), it is an acceptable addition to the HR InTouch content. If you have any questions related to the appropriateness of your submission, please contact us.
