The changing season reminds us that with change comes fresh perspectives and new opportunities. Let’s embrace this season together, support each other through transitions, and celebrate our achievements.

Join us at the October 22nd Member Welcome and Networking event!  This program combines two of our most popular events at a great venue.  We will kick off the event with GMA SHRM 101;  a great opportunity to learn about specific GMA SHRM programs and how your involvement with GMA SHRM can support you & your success!  That will be followed by a Member Networking Event!  Whether you are a newbie or a seasoned veteran, come and socialize and play games with other GMA SHRM members!

Legal Update – Termination Upheld for Refusal to Complete DE&I Training Requirements

The Seventh Circuit recently ruled against a former employee on his retaliation claim against his employer, who fired him for failing to complete mandatory DE&I training. In Vavra v. Honeywell Int'l, Inc., 106 F.4th 702, (7th Cir. 2024), Honeywell’s DE&I office rolled out an Unconscious Bias Awareness initiative, which included mandatory, online unconscious bias training to all its employees. The plaintiff employee, Charles Vavra, never clicked on the link to access the training and never completed the training despite direct instructions from his superiors. Vavra sent an email detailing his objections to the training. The HR office responded to Vavra’s objections and shared his concerns with others in HR. Upon a final request for him to complete the training, he refused and was subsequently terminated. Vavra sued Honeywell for retaliation by Title VII, arguing that his opposition to the unconscious bias training requirement was protected activity.

Under federal law, an employee’s opposition to an employer’s required action is protected from retaliation when the employee has an objectively reasonable belief that the action he is opposing violated the law. Here, Vavra’s belief that the training requirement violated the law was baseless because he’d never looked at the training and didn't know what the training consisted of.

The Seventh Circuit agreed with the lower court’s decision, finding that because Vavra never clicked on the link, he did not know what he was opposing and therefore, his belief is not objectively reasonable. Vavra previously assumed that the training would “vilify white people and treat people differently based on their race.” However, that assumption was purely speculative.

Employees cannot simply refuse to comply with DE&I training requirements because they disagree with the requirement, and then claim retaliation after termination. However, employers should still carefully evaluate the circumstances before terminating an employee who refuses to complete mandatory training.  Among other things, being consistent with all employees regarding the obligation to complete the training is key.

Committee Spotlight – Programming - Certification Committee

The GMA SHRM Certification Committee is organizing virtual study groups for those actively preparing to take the SHRM-CP or SHRM-SCP certification exams this winter. These sessions will be one-hour, virtual roundtable discussions designed as a supplement to the SHRM class offered through UW Small Business Development Center (UWSBDC) OR for those studying individually using the SHRM Learning System or other self-study material.

The anticipated sessions are November 15th, November 22nd, December 6th, and December 13th. Registration will be available on the GMA SHRM website and shared once available. You can review the class dates and further details regarding the UWSBDC class through this link: https://sbdc.wisc.edu/shrm-learning-system-certification-course/. The course starts September 18th and runs through November 20th.

HR InTouch Guidelines

Article Writing:
Do you have an interest in writing for the HR InTouch? We have an interest in learning more about your area of expertise!
Why should you volunteer? Top three reasons: 1) to share your knowledge and experiences to educate others; 2) to become more connected in the HR and Dane County communities; and 3) to contribute towards the advancement of GMA SHRM and the HR profession.
The first step is for you to choose a submission option: you can pre-submit an article to GMA SHRM at any time for us to use in any of the upcoming newsletters, you can sign up to write for a particular month, or we can put you on a list of people to contact in future months whenever we need articles.
Article length:
Because the HR InTouch is now in an online format, the size is flexible. The article should be engaging and hold readers’ attention. Include the core information in your article, and we will advise if it is too lengthy.
Solicitation:
GMA SHRM is conscious not to allow solicitation through the articles, in an effort to protect the interests of our partners and members. The nature of the article should be educational (i.e., what are the business advantages of having a product like yours) or informational. Otherwise, if you truly are interested in advertising through the HR InTouch, you can work with our Marketing Committee. As a rule of thumb for article writing, if the submission relates to a for-profit event, or specifically markets your company (vs. your industry), it is an advertisement, and should be purchased. If it is a not-for-profit event that your company is hosting, or an announcement (i.e., a SHRM member recently joined your company), it is an acceptable addition to the HR InTouch content. If you have any questions related to the appropriateness of your submission, please contact us.
