Greetings,

I am hoping by the time you read this that it will feel like spring is finally here.  It’s so hard to believe that by this time last year, we had already had multiple days in the 80’s! It’s that time of year when everyone is on spring break, the kids are getting ready to finish school, everyone is looking forward to summer, and March Madness is over.  There doesn’t sound like a better time to think about talent management and ditching the drama in the workplace.  Coincidentally (or maybe not!), those are the two keynote topics for our upcoming conference!

Registration is now open for the GMA SHRM Human Capital Conference. It will be held at the Alliant Energy Center on Tuesday, May 14th.  “HR: Game Changing”, the theme of this year’s conference, should provide wonderful learning opportunity for all of us. Every year the conference committee continues to WOW us with some incredible speakers, 2013 is no different. Check out the GMA SHRM website, newsletters, and weekly e-blasts for regular updates.  Don’t procrastinate, registration is now open!

GMA Members also have a unique opportunity to participate in a volunteer opportunity through SHRM.  The SHRM Advocacy Team is looking to establish an Advocacy Captain in each of the 435 congressional districts across the country. Advocacy Captains are committed volunteers who serve as the "go-to" people for lawmakers and their staffs on workforce-related issues. SHRM is currently looking for an Advocacy Captain in the greater Madison area where Mark Pocan serves.  Wisconsin is one of the 10 pilot states for this program which will be rolled out to all 50 states by 2014. Newly Revised Form I-9 Effective March 8, 2013

The U.S. Citizenship and Immigration Services (USCIS) have announced final form changes for Form I-9, effective March 8, 2013. The agency had proposed changes back in March of 2012; after receiving over 6,200 public comments on their changes, two subsequent revisions were made. The finalized form became available 3/8/13 and carries a revision date of "(Rev. 03/08/13)N" on the bottom, with an expiration date of 03/31/2016.  The Form and its instructions have been expanded to a total of nine pages.

Some important points to know about the new form are summarized below:
 
  • Employers should begin using the new form immediately. There is a 60 day grace period for implementation, but all employers need to be in compliance no later than May 7, 2013.  
  • New forms do not need to be completed for existing employees if there is already a correctly completed form on file unless there is a need to re-verify.  
  • The necessary retention period has not been changed: three years after the date of hire or one year after the date employment ended, whichever is later.
  • Other changes were made in order to limit errors and make filling out the form easier. Some of the changes include:
    • Adding new data fields for employee's foreign passport information and phone and email addresses
    • Improving the form's instructions 
    • Revising the layout; expanding the form from one to two pages (not including instructions and the List of Acceptable Documents.)  The employee section is still on the first page while the employer section has been moved to its own second page.

Compensation and Benefits

New Revised FMLA Regulations

The United States Department of Labor (DOL) recently issued revised regulations regarding the federal Family and Medical Leave Act (FMLA).  Pursuant to those regulations, all employers with fifty or more employees were required to post a revised FMLA poster in their workplace by March 8, 2013.  Any employer that has yet to install the revised poster should act now.

http://www.dol.gov/whd/regs/compliance/posters/fmla.htm.  Please remember that the DOL requires employers to install the poster in a prominent place (or places) where it can seen by both employees and job applicants.

In addition to the revised poster, the DOL has made changes to several other aspects of its regulatory scheme, including adding to the number of days that an eligible employee can take for certain aspects of military family leave, expanding the definitions of “military member” and “covered servicemember”, and issuing new model FMLA forms.  Each of the changes is highlighted on the DOL’s website.

HR manager had no free-speech protection to write private article against gay rights; top officials have fewer rights. Being at the top is not always a good thing. A university Vice President of HR was fired after writing a private opinion letter to a local newspaper objecting to the comparison of the gay rights movement with the civil rights movement for racial equality. The letter expressed indignation that "those choosing the homosexual lifestyle should be considered as civil rights victims." The article implied that gay people should not be afforded the same rights as African Americans. The fired VP sued, claiming a violation of her constitutional rights to express social and political views on her private, non-work time. The court dismissed the case. A Vice President of HR is in a policy-making position. She was in charge of implementing and enforcing the university's EEO policies which clearly included protecting rights and equal treatment on the basis of sexual orientation. A policy developer cannot undermine the key policies they are supposed to enforce without also destroying the public trust in the policies and the organization's effectiveness, even if the comments are off the job. There is far less off-the-job for top officials. A person who publicly expresses distain for the policies they are supposed to be responsible for should not be in that job. Dixon v. U. of Toledo (6th Cir., 2013).

Extra I-9 requirements for non-citizens result in $250,000 settlement. A food service company has settled a Department of Justice charge that it violated the anti-discrimination provisions of the Immigration Act by requiring non-citizen hires to go to extra lengths to provide additional Homeland Security documents, which were not required of U.S. citizens. The company stated that it was acting "out of an abundance of caution" for not violating the law's prohibition on hiring illegal workers. The law, however, specifies the proper I-9 process, and prohibits making non-citizens or suspected non-citizens to go to extra lengths. DOJ v. Centerplate, Inc. (Administrative Settlement, 2013).

The Greater Madison Area Society for Human Resource Management has established a professional award program to encourage the continual pursuit of education and training in the Human Resource field. One $1,000 award will be given to a GMA SHRM member to support his or her professional development. Scholarship recipients will be selected by the Professional Scholarship Committee based on demonstration of leadership qualities and interest in the human resources field, GMA SHRM participation, and a dedication to the advancement of the HR field. Community Events

Employers, LaFollette High School is Looking for Internship Opportunities

The internship is designed for upperclassmen (juniors and seniors) who have expressed interest in pursuing a specific career. Previous, current, and upcoming placements include positions in accounting, finance, marketing, sports marketing, retail marketing, administration, graphic arts, information technology, engineering, nursing, veterinary medicine, social work, construction, police science, and journalism to name a few.  In the end, we welcome and encourage all students to apply regardless of their career interest.

The internship program allows La Follette students the opportunity to gain invaluable, practical, and career-related work experience by applying classroom learning to an on-the-job setting. Students also earn high school credit and, in most cases, an hourly wage. In addition, students are also eligible to apply for one of three Career Internship scholarships, which are exclusive to La Follette Career Internship students. There is one $4,000 and two $2,000 scholarships awarded annually!
 
The two major components of the internship include classroom instruction coupled with on-the-job work experience. In terms of the classroom component, general work-related topics such as (but not limited to) cover letters, resumes, soft skill development, networking, goal setting, conflict resolution, and communication and leadership skills are discussed.
 
With regard to the actual internship placement and experience, students are expected to attend class daily and meet and/or exceed employer job performance expectations. They are also responsible for providing their own means of reliable transportation. Additionally, all Career Internship students have early release (2:00 or 2:45) from the normal school day in order to work at their placement site.
 
Below is a complete list of La Follette’s pre-placement requirements. It is important to note that not all students who apply for the internship class are accepted.  This screening process is beneficial to employers in terms of knowing students who do qualify must meet or exceed La Follette’s internal expectations.
 
Program requirements:
  • 2.5 GPA (minimum)
  • Junior/Senior status  
  • Review of school attendance record
  • Review of school tardy record
  • Review of school behavior record
  • Three letters of recommendations (staff/faculty)
  • Interview with a business/marketing teacher
  • Interview with potential employer
  • Reliable transportation (student provided)

This event is not only for our newest members, but also to those who have been members but are looking to get more involved and meet other HR professionals in the area. Attendees will have an opportunity to meet each of our board members and learn about their specific committees and how they can get involved.  Attendees will also learn about all the great programs and events GMA SHRM offers its members throughout the year.

Volunteers Needed - PHR/SPHR Study Group 

Each year GMA SHRM offers a study group for those preparing for the PHR or SPHR certifications.  This year the meetings are focusing on open discussion/dialogues for participants on topics in any of the modules as well as test taking skills.  We are looking for someone who is willing to facilitate a study group this spring for those preparing to take the certification test during the spring testing window.  The facilitator helps group participants to understand the answer to a question, reviews test preparation questions and is available as a resource for the participants.

What is the focus of your position? 
I’m part of the Business Services Team at the Dane County Job Center. We work with area employers to help them meet their workforce needs.

How long have you been in the Human Resource field?
I worked for the South Dakota Department of Labor and Regulation for past 26 years and have been with the Wisconsin Job Service since l moved to Wisconsin last October.
 
Which of your career accomplishments makes you proudest? 
I love it when a service I can provide helps an employer to improve their bottom line by making better hiring decisions.

What is the best advice you’ve ever received? 
Always do your best and don’t worry about whether anyone else notices.
 
Why did you decide to join GMA SHRM?
I was active in the local SHRM chapter in South Dakota and made many good friends and learned so much.  I knew SHRM would be a great way to meet some kindred spirits!

I have not yet joined other committees for GMA SHRM, but I also volunteer for several other organizations in the Madison Area such as the UW Carbone Cancer Center and the Dane County Humane Society.
 
What do you enjoy about volunteering? 
Overall, I just enjoy giving back to my community. For GMA SHRM, I really enjoy being a part of the committee focused on offering scholarships and professional development opportunities.

What would you say to others who are considering volunteering with GMA SHRM?
I would strongly encourage members to volunteer for GMA SHRM. Volunteering is a great way to meet and work alongside other HR professionals from a variety of industries. It’s a great way to gain work-related experience and contribute toward a dynamic and valued local SHRM chapter. 
                     
What have you gotten back from volunteering with GMA SHRM?

It has been rewarding to be a part of a group that is intrinsically motivated to advance the HR profession in the Madison area. I’ve met some really wonderful HR professionals.

HR InTouch Guidelines

Article Writing:

Do you have an interest in writing for the HR InTouch? We have an interest in learning more about your area of expertise!

Why should you volunteer? Top three reasons: 1) to share your knowledge and experiences to educate others; 2) to become more connected in the HR and Dane County communities; and 3) to contribute towards the advancement of GMA SHRM and the HR profession.

The first step is for you to choose a submission option: you can pre-submit an article to GMA SHRM at any time for us to use in any of the upcoming newsletters, you can sign up to write for a particular month, or we can put you on a list of people to contact in future months whenever we need articles.

Article length:

Because the HR InTouch is now in an online format, the size is flexible. The article should be engaging and hold readers’ attention. Include the core information in your article, and we will advise if it is too lengthy.

Solicitation:

GMA SHRM is conscious not to allow solicitation through the articles, in an effort to protect the interests of our partners and members. The nature of the article should be educational (i.e., what are the business advantages of having a product like yours) or informational. Otherwise, if you truly are interested in advertising through the HR InTouch, you can work with our Marketing Committee. As a rule of thumb for article writing, if the submission relates to a for-profit event, or specifically markets your company (vs. your industry), it is an advertisement, and should be purchased. If it is a not-for-profit event that your company is hosting, or an announcement (i.e., a SHRM member recently joined your company), it is an acceptable addition to the HR InTouch content. If you have any questions related to the appropriateness of your submission, please contact us.

 Amended
